GENERAL TERMS AND CONDITIONS

Descriptions

specific descriptions and illustrations of our products and services on our website and our literature reflect, as far as possible, an accurate representation of the products and services that we offer. Photographs are intended to give a general idea or flavour of the dance style or the atmosphere of a typical event but do not form part of any contract between you and Dance Dynamic or its suppliers. In all instances the specific manner of any teaching, training, coaching or the general running of an event may vary from teacher to teacher and location to location.


Definitions

Class - a teaching session for a group.

Personal Lesson - a personalised teaching session with one teacher per individual or couple. This does not mean the exclusive use of the dance studio and its facilities and it is quite normal for other personal lessons to be in progress simultaneously.

Course - a series of consecutive classes.
 

Payment

Courses, classes, bookings and merchandise can be paid for through credit card/debit card, Paypal through the website, cheque or cash. Credit/debit card payments can be made by telephoning the studio or by visiting the studio during open hours.
 

Validity Period for Gift Vouchers

The validity of gift vouchers are usually valid for twelve months from the date of your payment or from the acceptance by Dance Dynamic in respect of a voucher issued by a third party. Unless otherwise stated all vouchers are open for redemption for a period of 12 months from the date of purchase. You must complete your activity prior to the expiry date. If you are unable to complete your booking within the validity period, the period can be extended for up to six months. An extension can only be done once and must be done within the validity period. A £15 administration fee is payable if you choose to extend your validity. If the price of our dance lessons increase, you will also be required to pay the difference.


Contract, Changes and Cancellations

For any of our courses and classes/lessons, payment is required in advance to secure your booking. The receipt of your payment confirms your acceptance of our terms and conditions and will constitute a contract governed by English Law. The services provided to you by ‘Dance Dynamic’ include research, evaluation, sourcing, validation, administration, booking services, and marketing to make available to you our products and services and to facilitate your enjoyment of them. However, they are not provided free of charge and our charges for these services are included in the price you pay.

Having booked dance Lessons or courses with us, your deposit is non refundable and your payment is deemed to be acceptance of our terms and conditions.

 

a.      Having booked, no refunds will be issued except in respect of non-performance of the contract.
To be clear, if, for example, you book a course and then, for whatever reason, wish to cancel, no refund will be made. In some circumstances, it may be possible for us to defer further lessons for a limited period, subject to the type of dance lessons or activity you have booked. If, in the meantime, the price of the product or service booked has increased, you will be required to pay the difference for the deferred element.

If you have paid for a course of dance lessons and you miss a class, no refunds will be given (except in exceptional circumstances or unless). It is discretionary whether unused classes can be carried over to a different period .

b.      All classes, lessons and instructional bookings are payable in advance. A 50% deposit is required at the time of booking and the balance paid on or before your first session. Please note that 48 hours clear notice of cancellation or postponement is required otherwise we regret that we are unable to credit the fee to a future appointment.


c.      If you do not attend an activity onto which you have been booked, you will be deemed to have cancelled your participation and no refund will be considered.

d.      If, having made a booking, you wish to change the course or lesson booked, there may be an administrative charge. You will be advised of this before you instruct us to change the package booked and payment will be required before the change to the booking can be confirmed.
e.     In some classes there is an opportunity to pay on a daily basis at a higher rate, this does not guarantee you a place on the session and if the class is full you will not be able to attend and asked to leave.


Monthly Membership

a.     Monthly membership fees – the fees you must pay each month by standing order for the month to come.
b.     an additional £20.00 administration fee is required to initiate a 6 month contract and is non refundable.
c.     First month is payable by debit/credit card or Paypal online, the remaining 5 months paid by standing order monthly. If you stop paying the monthly fee, we ask you to pay what you still owe.
d.     Initial term – the period which ends 6 months after the date you join. You may not cancel your membership during the initial term unless you can give us a doctor's medical certificate or a letter confirming redundancy from your employer. The cancellation will only apply when we receive a medical certificate or employer's letter.
e.     At the end of the 6 month period we will contact you to advise you of this and provide you with information on renewal


About your Membership

a     The standard membership offer you free access to the majority of all dance classes. It excludes Pole Dance, Burlesque, Can Can, all one day intensive courses
b.     The Gold Card membership offers free access to all of the dance classes including Pole dance, Burlesque, Can Can and all the one day intensive courses.
c.     Both membership schemes exclude privately booked lessons and specialist workshops
d.     Membership fees are subject to periodic increases (normally annually)
 

Your Membership Card

a. You will receive a membership card and must present your membership card at commencement of each class. If you forget your card, we may need to see proof of identity
b. Your membership applies to you and you cannot loan or transfer it to another person.

 

Providers

Activities featured by Dance Dynamic are provided by suppliers who are neither employed by, nor acting as agents of, Dance Dynamic. Although we have visited many of the suppliers, we are unable to examine all the facilities of every single supplier, nor are we able to vet every single one of their employees. Consequently, Dance Dynamic cannot accept liability for any act or omission or negligence of a supplier, nor any other liability arising out of the provision of the activities to you. Dance Dynamic does not accept liability for damage to property or consequential loss or injury of any kind, except where death or injury is caused by the negligence of Dance Dynamic or its servants or agents. In no circumstances shall Dance Dynamic's total liability for any claim exceed the price of the product or service supplied nor shall it be liable for any extra costs incurred such as travel costs, meals, or loss of earnings.


Restrictions

For safety reasons, some activities have certain size, age and health restrictions. Unless the activity is part of our Children’s Dance Classes or is otherwise stated on the website or in the promotional literature, the minimum age for any of our dance activities is 16.
You are required to notify Dance Dynamic and the Supplier of any relevant medical condition and, if in doubt, to consult your medical practitioner.
Dance Dynamic provider reserves the right of admission.


Children’s Dance Classes

It is the responsibility of the participant's parent or guardian to seek appropriate medical approval regarding any pre-existing condition and to disclose any such condition to Dance Dynamic before booking. Dance Dynamic and its representatives accept no liability arising from the medical condition of any participant.
The dance styles offered are the dance styles available at the appointed dance location and are subject the dance coach's discretion with regard to suitability in terms of age, sex, ability and experience.
The participant may be excluded from the dance classes in the event of inappropriate behaviour and any form of bullying will be dealt with under our anti bullying policy.
It is the responsibility of the parent or guardian to ensure a child is picked up on time and Dance Dynamic may make a charge for the late collection of participants from class.


Payment of Children’s Classes

For the first 3 weeks there is an option to pay on a daily basis per hour and following this period the 6 weekly payment must be made. If your child does not attend an activity onto the period that has been booked, they will be deemed to have cancelled their participation and no refund will be considered.

 

Activity Timings

These are given as a guide only and you may be required to wait between different elements of the activity while another activity takes place.
If we cancel or change your activity
If we cancel your activity, we will tell you as soon as possible, and do our very best to offer an alternative. We reserve the right to cancel your activity at short notice and re-book you. We reserve the right to reschedule the timings or location of any activity owing to unavailability of the activity, insufficient numbers making the activity unavailable, and other factors beyond our control.


We reserve the right to discontinue an activity, venue, or individual supplier at our own discretion. We will endeavour to offer a suitable alternative activity of the same value, however, if not we will refund your payment in full. If you wish to exchange for an alternative activity of a higher value, you will be expected to pay the difference in price. We also reserve the right to make minor changes to your activity.


Pole Dance Courses

There must normally be a minimum of 4 people for the Pole fitness dance courses to run and courses are designed for 2 people per pole to ensure maximum benefit.

 

Events (Adults)

There is a £50 non refundable booking fee (which must be paid in advance at the time of booking) and an additional cost of £20 per person. Full payment must be made14 days before the party date. If the balance is not paid by this time we reserve the right to cancel your class, without refunding the deposit. If you book a class 2 weeks or less before the date of the class, you will need to pay in full. A 10% discount is available for parties that are settled in full 30 days prior to the party date.
 

Events (Children)

There is a £50 non refundable booking fee (which must be paid in advance at the time of booking) and an additional cost of £5.00 per person. Full payment must be made14 days before the party date. A 10% discount is available for parties that are settled in full 30 days prior to the party date.
The minimum number of children attending is 5 and the maximum 20 in any one party
Parties are suitable for children aged 5 – 18 years


Availability

Bookings will only be secure once a deposit has been paid and slots may be held for up to a maximum of 5 days before this is received.
Transferring dates


Once payment has been processed, you are booked for the specific date and venue you have asked for. You may transfer the date up to 4 weeks prior to the date of your party. Within 4 weeks, Dance Dynamic will agree to transfer you as long as we have a replacement group to take your place for your original date booked.


Refunds

The following applies to refunds for all private lessons and parties:
*28 days notice prior to event – refund minus £20 administration fee
*Less than 28 days notice, more than 14 days – no refund, however groups are eligible for a date transfer
*Less than 14 days – A refund or date transfer is unavailable.
 

In case of problems

In case of a problem, please speak to a representative from dance Dynamic so they have the opportunity to resolve any problems there and then. Any other complaints should be put in writing and addressed to Dance Dynamic’s correspondence address.


These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The purchaser and supplier agree that any problems fall under the jurisdiction of the English courts. All the clauses and sub clauses in our terms and conditions are independent of each other. If one clause or sub clause is invalid or unenforceable, this will not affect any other clause or sub clause.
